Welcome and thank you for your interest in Unikname, its websites, and all related websites, mobile applications (including applications for tablets) and other services provided by Unikname and on which a link to this privacy policy is displayed, as well as all other communications by written or oral means, such as email or phone.

Unikname products and services are developed by the Space Elephant SAS company.

1. Preamble

The Space Elephant company (hereinafter the “Company”, “us”, “we”, etc) offers various services based on the Blockchain technology, as defined hereafter, to the Users of its websites https://www.unikname.com/ and https://unikname.network/, the Users of all its other websites or applications, in particular the My Unikname App, the Unikname Network Hub and the Dashboard, owned and operated by the Company (hereinafter the “Websites and applications”), and its Clients.

Space Elephant greatly values the protection of personal data and the respect of privacy.

This privacy policy, accessible at the following address https://www.unikname.com/privacy-policy/ (hereinafter the “Privacy Policy”), is intended to inform the Company’s Clients, Delegates and Users of the manner in which it handles the Personal Data provided to it. It is applicable to all Users of the Websites and applications as well as to the Company’s Clients and Delegates.

All Personal Data Processing is carried out in accordance with the French law n°78-17 of January 6, 1978, as amended, and the European Regulation n°2019/679 on data protection of April 27, 2016 (known as “GDPR”).

The Company may modify the Privacy Policy at any time. These changes will be notified in a visible manner on the https://www.unikname.com/ website. Affected people will also be notified by email.

The Company’s Clients, Delegates and Users expressly acknowledge and agree that the Services are based on Blockchain technology through a semi-public governance, which includes a decentralized aspect, and is therefore not under the control of the Company.

2. Definitions

For the purposes of this Privacy Policy, capitalized terms shall have the following meaning:

Blockchain: refers to the Unikname.network blockchain developed by the Company, which consists of a semi-public shared ledger in which data is stored and distributed on a large number of servers managed by Delegates. All entries, since the initialization, made in this ledger (by means of “Transactions”), are visible to all Users and cannot be removed. The integrity of these entries (their resistance to tampering or censorship) is guaranteed by the cryptographic mechanisms at the heart of the Unikname.network protocol.

Community: a group of natural or moral persons having a common interest to share messages, data and Transactions on the Blockchain.

Company: refers to the simplified joint stock company Space Elephant, having its head office at 42/43 Quai Malakoff, 44000 Nantes, France, registered at the RCS of Nantes under the number 8391934222 and represented by its president Mr Laurent Lourenço.

Delegate: means a legal or natural person who offers or proposes to offer a management service of a server containing a copy of the public Blockchain ledger and available to the whole Community.

Decentralized Identifier: a unique identifier of a verifiable and decentralized digital identity. Identifiers are designed to allow their owner to attach Verifiable Claims to them, constituting a decentralized verifiable identity under his sole control and independently of any centralized registry.

Data Controller: means, within the meaning of the GDPR, the natural or legal person, public authority, department or other people which, alone or jointly with others, determines the purposes and means of the Processing. The Company is considered as a Data Controller only when it processes the Personal Data of Users and/or Clients to provide them its Services and within the limits of the purposes described below. In particular, the Company is not a Data Controller when the User and/or the Client takes the initiative to enter Personal Data within the Transactions of the Blockchain.

Data Processor: the natural or legal person, public authority, department or other organization that processes Personal Data on behalf of and in accordance with the instructions of the Company solely to meet the purposes described below and in the context of the Services.

NFT-Factory: means the system that manages and controls the creation and evolution of UniknameID. It is implemented by the Company or its possible licensed partners specifically to offer this service of identifiers to Clients, Delegates and/or Users.

Personal Data: any information relating to an identified or identifiable natural person, directly or indirectly, in particular by reference to an identifier, such as a name, phone number, address, etc., which is processed by the Company (excluding any sensitive data, such as data relating to health, ethnic origin, etc.).

Public Key: cryptographic key associated with a unique Private Key and generated locally by the My Unikname App. The Public Key is published by the app on the Blockchain and is publicly linked to the obfuscated form of the UniknameID. This key is known by everyone and allows the User to authenticate.

Private Key: cryptographic key associated with a unique Public Key and generated locally by the My Unikname App. The Private Key is stored only in the User’s device (smartphone or tablet) and is known only to the User. The Company has no knowledge of this key and has no way to access it.

Processing: sets of operations performed or not performed using automated processes on Personal Data transmitted by Clients, Delegates and/or Users in the context of the Services, such as collection, recording, storage, consultation, use, communication by transmission, deletion or destruction.

Recipient: the natural or legal person, public authority, service or any other body that receives communication of Personal Data, whether or not it is a third party.

Services: means the provision by the Company to its Users and Clients of the Unikname decentralized identity platform solutions, in particular Unikname Connect, Unikname applications, in particular My Unikname App and the Dashboard, as well as the provision of associated services, such as the NFT-Factory service.

Token: means a digital asset issued and tradeable on the Blockchain, in particular against a UniknameID. The Token is publicly held on the Blockchain by a Public Key. Token exchanges take place through Transactions.

Transaction: mechanism by which information (some data or a transaction) is written in the Blockchain. All Transactions since the initialization of the Blockchain are visible by all and are immutable.

Unikname Connect: authentication solution based on the Blockchain, developed by the Company and proposed to its Clients so that they can offer their users/clients a secure and confidential access to their website and/or platform; or to secure the administrators’ access to their platform.

UniknameID: refers to a decentralized identifier that can be memorized, acquired by Clients, Delegates and/or Users from the NFT-Factory. The issuance of a new UniknameID on the Blockchain is done through a Transaction. The UniknameID is public in its obfuscated form. Only the User can choose to publicly reveal the explicit form of their UniknameID. As long as they does not do so, no one, in particular the Company, is aware of the explicit form.

User: means any natural or legal person who uses the Company’s websites and/or applications, in particular My Unikname App, the unikname.network Hub and the Dashboard, as well as the associated Services.

Verifiable Claim: means a statement about a Decentralized IDentifier that is non repudiable and whose issuance can be cryptographically verified. In general, verifiable claims are stored only on the User’s device through the My Unikname App. It is the User who chooses if they want to publish the statement in the Blockchain. Some Services, implemented by the Company or by licensed partners, may require the writing of claims or certification proofs in the Blockchain. These are never Personal Data. In such cases, the User is warned and reminded of the immutable nature of such writing.

Whitelist: means the list in which Clients, Users and Delegates wishing to participate in the sale of Tokens, register. The Whitelist is managed by the Company on its private servers. The Whitelist contains Personal Information that is accessible by the Company.

3. Collected Personal Data

The Company only collects Personal Data directly provided by Clients, Delegates and/or Users and which are strictly necessary for the provision of the Services.

When browsing the websites

Data of the Clients, Delegates and Users related to the navigation on the websites (timestamp, redacted IP address (2 bytes), location (city and country), technical data related to the equipment and browser used, cookies, trackers).
This data is part of the information required for the operation of the websites and its collection does not require the consent of the Clients, Delegates and Users.

When browsing the forum while logged in

  • Email address of the Client, the Delegate or the User if he/she wishes (optional) to answer questions, to receive comments
  • Free comment area which may contain Personal Data filled in by the Client, the Delegate or the User and that will be accessible to the public (the Company recommends however not to fill in any Personal Data in the comment area)

 

Relevant website

When installing the My Unikname App mobile application (smartphone and/or tablet) and getting a UniknameID with the application

  • The obfuscated form of the UniknameID is written into the Blockchain by the NFT-Factory and cannot be erased. The obfuscation protects the explicit form from known brute force attacks. However, the Company declines any responsibility in case of malicious revelation of the explicit forms
  • The NFT-Factory does not collect or store any information. The only identifying data could come from the UniknameID’s explicit form chosen  by the User and which he/she voluntarily and consciously made public
  • The Private Key is generated automatically and locally by the application and is known only to the User. It is never transmitted to the Company.
  • The User’s email is collected for a subscription to the newsletter (optional)

When the User uses the My Unikname App mobile application (smartphone and/or tablet)

Any Personal Data that may be entered by the User in the My Unikname App, namely their email, phone number, their UniknameID, and their browsing history, are stored only in the User’s device and are not collected by the Company.

When the Client uses the Dashboard application

  • Last name, first name, email, phone number, company of the Client and the position of the Client in their company to adapt the offer to the Client.
  • Personal Data freely communicated by the User to answer a request, ask a question, or exercise a right

When registering to the Whitelist from the Unikname Network Hub application

  • Last name, first name, email, country to contact Users wishing to participate in the sale of Tokens and to verify that their country of residence allows them to participate
  • Personal data freely communicated by the User to answer a request, ask a question, or exercise a right

When using the Unikname Network Hub application

  • First name, Last name, email, Whitelist ID, Unikname Network Hub account ID, affiliation ID and affiliate ID of the User in case of subscription to the affiliation program (optional)
  • Personal data freely communicated by the User to answer a request, ask a question, or exercise a right

When using the Unikname Network Delegate application

  • Free description zone that can contain Personal Data filled in by the Delegate and that will be publicly accessible
  • Usernames on the Delegate’s social networks twitter, github and forum (optional but encouraged)

  • Quality of Service for the Delegate’s server (optional)
  • Information about the contributions made by the Delegate to the Community (optional)

5. Data Recipients

The following may be Data Recipients of all or part of the personal data:

  • the Company’s staff in charge of the technical administration and security of the Websites and applications as well as the Services;
  • the Company’s staff in charge of the relationship with Clients and Users and the processing of requests and questions;
  • the authorized personnel of the Company’s Data Processors for the purposes and under the conditions specified above, and in particular the partners licensed by the Company to operate the Services;

These Data Processors may process Personal Data on behalf of the Company, for example, for payments, hosting, sending emails, promoting or providing the Services, or administering the tools and solutions. The use of Data Processors is governed by a contract that requires them to implement appropriate technical and organizational measures to protect Personal Data.

Other third parties to the extent necessary to: (i) comply with a governmental request, court order or applicable law; (ii) prevent unlawful uses of the Company’s websites and applications ;

No transfers of Personal Data outside the European Union are made. 

6. Retention Period

As indicated above, the Company keeps few Personal Data. Personal Data will only be retained for as long as necessary for the various purposes of the Processing. The duration for which the Company needs the Personal Data varies depending on the purpose for which it was provided. In any case, Personal Data is kept at least for the duration of the use of the Services and will not be kept beyond 3 years after the User, the Client or the Delegate ceases to use the Services.

7. Exercise of rights

The Client, the Delegate and the User have, in accordance with the national and European regulations in force, a right of access, rectification, deletion, opposition, portability and limitation of the Processing with regard to the information concerning them.

About the Newsletter, the Client, the Delegate and the User may unsubscribe at any time via the unsubscribe link at the end of each email.

8. Security

The Company implements all the means at its disposal to guarantee the security of its Services.

In particular, UniknameID identifiers are stored locally on the User’s, Delegate’s and/or Client’s device (smartphone or tablet), within the My Unikname App, all information pertaining to it is encrypted with the AES256 protocol and protected by a PIN code within the User’s, Delegate’s and/or Client’s device, or with a biometric fingerprint, to which neither the Company nor any other third party has access.

In general, the Processing of Personal Data complies with the legal and regulatory requirements for the protection of Personal Data. The Company undertakes to set up appropriate technical and organizational measures to ensure the protection of Personal Data and to allow the exercise of the rights of the affected people. In particular, the Company undertakes to take the necessary precautions to preserve the security and confidentiality of Personal Data and in particular to prevent them from being distorted, damaged or communicated to unauthorized persons.

Finally, the Company undertakes to notify the Clients, the Delegates and the Users of the occurrence of a possible violation of their Personal Data.

9. Management of cookies

A “cookie” is a string of information, usually small and identified by a name, that can be transmitted to the browser of the user of a website. The user’s web browser will keep it for a certain period of time, and will send it back to the web server each time the user connects. Cookies have multiple uses: they can improve navigation on websites, save the user’s preferences, trace their navigation for statistical or advertising purposes, etc.

When the User visits the Company’s applications and websites for the first time, so-called “functional cookies” are automatically deposited because they are necessary for the operation, performance and security of the websites and applications. These cookies are not subject to any prior consent.

The Company does not deposit other cookies for advertising targeting or content sharing on social networks.

At any time, the User can set and manage his/her choices regarding cookies directly in his/her browser. However, if the User refuses “functional” cookies, it is possible that certain parts of the websites or applications cannot be used in the best conditions.
